1. PURPOSE

The purpose of these Terms and Conditions is to regulate the commercial relationship between ROOM00 HOSTELS & HOTELS S.L.U, depending on the hotel in which the reservation is made (hereinafter “Room00 Group”) and its customers (hereinafter the “Customer”). Room00 Group owns, operates, and manages a series of properties under its brands Letoh, Select, TOC, Room00, as well as a series of websites and applications to receive, manage, and accept hotel reservations (its “Websites”), including through the websites of Room00 Group’s booking service providers (hereinafter the “Provider Website”). These Terms and Conditions, together with all legal texts such as the Privacy Policy, Legal Notice, and Cookies Policy, establish the contract between the Parties (collectively the “Conditions”).

2. CHARACTERISTICS OF THE SERVICES

Room00 Group, through its Websites and through third-party booking service providers, provides accommodation booking services (hereinafter the “Accommodation(s)”) through which the Customer may book rooms in hotels or other types of accommodation managed by Room00 Group (hereinafter the “Services”).

3. BOOKING CONDITIONS

To book Accommodation with Room00 Group, the Customer must be of legal age. When the Customer wishes to book Accommodation with Room00 Group, they must follow these steps:

· Enter search criteria: the Customer must provide Room00 Group or booking service providers with the booking details to determine availability, including dates and number of guests. If no availability exists, the Customer must adjust the search criteria.

· Select room type: if Accommodation is available, the Customer must select the preferred room type.

· Additional services: together with the booking, the Customer must indicate whether they wish to add extra services such as breakfast, cancellation service, room amenities, among others.

· Payment: once the room and additional services are selected, the Customer shall proceed with payment.

Once payment is completed, the Customer will receive a confirmation email for the Accommodation booking with the selected dates and conditions.

4. PAYMENT PROCEDURE

The Customer may contract the Services through the payment process provided on Room00 Group’s Websites or its booking service providers’ websites. Once completed, the Customer must accept these Conditions, which establish the contractual framework between the parties. After acceptance, the Customer will pay the price of the Services through the payment gateway used by Room00 Group. Any Service may be rejected or cancelled if there is a manifest pricing error, insufficient or inaccurate billing/payment information, or suspicion of fraud or payment disputes.

5. PRICES

Service prices are those displayed at any given time on Room00 Group’s Websites or on its booking providers’ websites. Payments are generally non-refundable unless the Customer has expressly purchased a free cancellation option. Room00 Group reserves the right to modify prices without affecting already confirmed bookings. Prices do not include local occupancy taxes, which must be paid at the accommodation if applicable.

6. RIGHT OF WITHDRAWAL (CANCELLATION POLICY)

The Customer acknowledges that once the Services are contracted, Room00 Group is not required to provide a right of withdrawal, in accordance with applicable consumer law exceptions (Article 103.l of the Spanish Consumer Law). Therefore, in general, early cancellation will not result in a refund unless a cancellation service has been specifically purchased.

7. CUSTOMER OBLIGATIONS

By contracting the Services:

a) The Customer must provide accurate and lawful information. Room00 Group is not responsible for false or fraudulent information.

b) The Customer must use the Services in compliance with applicable law, these Conditions, good faith, and public order principles. The Customer is liable for any damages caused by breach.

c) The Customer must pay the price of the Services:

a. Fraudulent, incomplete, or irregular bookings may be cancelled without prejudice to further legal actions.

b. Room00 Group may expel the Customer from the accommodation in case of inappropriate behavior, without compensation or refund.

d) The Customer must respect house rules and use facilities properly.

8. TERM

These Conditions remain valid from the moment of booking until the end of the Services.

9. LIABILITY

Room00 Group strives to ensure accurate information but does not guarantee completeness or accuracy. It is not responsible for errors, omissions, or third-party website content. Room00 Group is not liable for system failures, internet issues, viruses, interruptions, or force majeure events. Liability is limited to foreseeable damages resulting from gross negligence in essential contractual obligations.

10. WARRANTIES

Services will substantially conform to their description. However, Room00 Group does not guarantee uninterrupted or error-free service. Services are provided “as is” to the maximum extent permitted by law.

11. INTELLECTUAL PROPERTY RIGHTS

Room00 Group owns the intellectual and industrial property rights of its Websites. No rights are transferred to the Customer except as expressly stated. Unauthorized use, reproduction, scraping, or distribution is strictly prohibited.

12. PERSONAL DATA PROTECTION

Personal data will be processed according to Room00 Group’s Privacy Policy. The Customer guarantees lawful consent when providing third-party data, including minors where applicable.

13. THIRD-PARTY LINKS

Websites may contain links to third-party sites. Room00 Group is not responsible for their content or use.

14. COMMERCIAL COMMUNICATIONS

Unless the Customer opts out, Room00 Group may send commercial communications related to its services.

15. COMPLAINTS

The User may submit complaints via email: administración@room00group.com or other available contact methods.

16. MODIFICATIONS

Room00 Group reserves the right to modify these Conditions at any time. Updates will be communicated via the Website.

17. JURISDICTION

Spanish law shall apply. Courts of Madrid shall have jurisdiction, without prejudice to mandatory legal provisions or alternative dispute mechanisms.
